Actual Cases

Williams Kherkher - Houston, Texas

Click here to see video re-creations of the crossing collision in Lesly v. Union Pacific. These videos were used to demonstrate why the driver of a cotton module truck did not see the approaching train, even though he stopped and looked. One video is an overhead view that shows the driver's line of sight from the truck to the tracks when approaching the crossing. The other video is a driver's eye view from inside the cab of the truck until the moment of impact. This case settled prior to trial.

The case of Martin v. BNSF involved a train traveling 52 miles per hour in a 49 mile per hour track speed limit zone. Click to see a video that demonstrates what would have happened if the engineer had slowed the train to the authorized speed of 49 miles per hour for only 1 minute before reaching the crossing. Then click to see the video that recreates what actually happened, from a driver's eye perspective. This crossing now has lights and gates. The case settled prior to trial.
